Ground breaking judgment of the European Court of Justice on EU Citizenship

On Tuesday 2 March 2010, the Court of Justice gave a potentially groundbreaking judgment on the scope and effects of EU Citizenship.

On the Rottmann case, the Court held that the national court should consider whether or not the decision of German nationality authorities to withdraw a naturalisation decision obtained by deception was proportionate in view of the fact that it resulted in the subject becoming stateless.

In a kick off contribution to the Forum of CITSEE's sister project the EUDO-Citizenship Observatory, I set out the facts of the case, the Opinion of Advocate General Maduro, and the judgment of the Court of Justice. I also raise some questions about the challenges which this judgment poses both for the EU legal order and for national citizenship laws.
